George W. Bush (“Bush 43”) won office as a result of a highly contested election that was ultimately decided by the Supreme Court, dividing the country anew after the polarizing Clinton impeachment. The son of the forty-first president, George W. Bush sought to build a new, more powerful presidency. When ter­rorists struck the World Trade Center on 9/11, Bush used the full authority of his office to wage an unprecedented “war on terror.” In pushing through the USA Patriot Act, beginning secret NSA wiretaps, defending extraordi­nary interrogation techniques, and imprisoning “enemy combatants” in mili­tary prisons at Guantanamo Bay, Bush and his vice president, Dick Cheney, pushed executive powers to new heights. Ironically, both the nation and the Supreme Court—which seemed prepared to give Bush extraordinary author­ity to protect the nation after 9/11—concluded that he went too far. Thus, Bush 43 left behind a mixed legacy as a president who did a commendable job fight­ing a new war on terror, but in the process may have insisted too much on his own controversial understanding of the constitutional presidency.
