The rise of the administrative state is the most significant political development in American politics over the past century. While our Constitution separates powers into three branches, and requires that the laws are made by elected representatives in the Congress, today most policies are made by unelected officials in agencies where legislative, executive, and judicial powers are combined. This threatens constitutionalism and the rule of law.

Legal precedents created during Prohibition have lingered, leaving search-and-seizure law much better defined than limits on police use of force, interrogation practices, or eyewitness identification protocols. Intrusive searches for alcohol during Prohibition destroyed middle-class Americans' faith in police and ushered in a new basis for controlling police conduct. As Prohibition drew to a close, a presidential commission awakened the public to torture in interrogation rooms, prompting courts to exclude coerced confessions.

Possibly the most emotionally charged debate taking place in the US today centers on the Second Amendment and the rights of citizens to bear arms. In the wake of school massacres, the gun rights movement, headed by the National Rifle Association, appears more intractable than ever in its fight against gun control laws. Their core argument is that the proliferation of firearms is essential to maintaining freedom in America, providing private citizens with a defense against possible government tyranny, and thus safeguarding all our other rights. But is this argument valid? Do guns indeed make us free?
